Terms of service

These terms govern your use of Pump House, an Australian-based software service for fire safety contractors. By creating an account you agree to them. If you do not agree, do not use the service.
1. Definitions
- Pump House, we, us: the software service operated by STANDING CLEAR PTY LTD (ABN 19669522847), Sydney, NSW, Australia.
- You, your: the person or business using the service.
- Account: the credentials that let you sign in to Pump House.
- Organisation: a business workspace inside Pump House. One account can belong to several organisations.
- Customer Data: data you put into Pump House. Buildings, defects, photos, reports, audit trail, settings.
- Service: the Pump House web application, mobile app, and any related APIs or features.
2. Acceptance
By creating an account or signing in, you agree to these terms and the Privacy Policy.
You must be at least 18 and have legal capacity to enter contracts. If you sign up on behalf of a business, you confirm you have authority to bind that business to these terms.
We may update these terms. If we do, we will notify the account owner by email at least 14 days before the change takes effect. Continuing to use the service after the change means you accept the new terms.
3. Account
You are responsible for keeping your sign-in credentials secret. You are responsible for everything that happens under your account.
If you suspect your account has been compromised, contact us immediately at [email protected] and we will help you secure it.
You can have multiple users in one organisation. The organisation owner controls who has access.
4. Subscription
Pump House is a paid subscription service. Pricing, billing cadence, and refund terms are finalised before the first paid invoice.
During the alpha period (before customer-1 invoice), use of the service is provided at no charge. Standard subscription terms begin from the date of your first paid invoice.
You can cancel your subscription at any time from inside the app. Cancellation takes effect at the end of your current billing period.
5. Acceptable use
You can use Pump House for any lawful purpose related to fire safety inspection, maintenance, and compliance management.
You agree not to:
- Use the service to break any law, including Australian privacy law, copyright law, or building or safety regulations.
- Upload content you do not have the right to upload.
- Try to reverse-engineer, decompile, or extract our source code.
- Probe, scan, or test the vulnerability of any system without our written permission.
- Use the service to send spam, malware, or any content that harms another user.
- Resell or sublicense access to the service without our written permission.
We can suspend or terminate accounts that breach this section. Where the breach is minor or accidental, we will normally contact you first and give you a chance to fix it.
6. Intellectual property
We own Pump House: the software, the design, the brand, all of it. Using the service does not transfer any of that to you.
You own your Customer Data. Putting data into Pump House does not transfer ownership of that data to us. We hold it on your behalf for the purposes set out in the Privacy Policy and these terms.
If you give us feedback (suggestions, bug reports, feature requests), we can use that feedback to improve the service without paying you or crediting you.
7. Customer data
You own your data. Always.
Pump House stores your data, processes it on your behalf, and gives you tools to manage it. We do not sell it. We do not use it to train AI models for our own benefit. We do not share it with third parties except as set out in the Privacy Policy (mainly: the hosting, email, and AI vendors we use to operate the service).
The Privacy Policy explains exactly what data we collect, how we use it, and how you can export or delete it. Read that before you decide to use the service.
When you delete your account, we delete your data per the deletion procedure described in the Privacy Policy.
8. Confidentiality
We treat your business information, your customer lists, your pricing, your inspection workflows, and any other non-public information you put into Pump House as confidential. We use it only to provide the service to you.
You treat any non-public information about Pump House (pricing we have not published, technical details, future features we have discussed with you) as confidential. You use it only to evaluate or use the service.
9. Termination
You can terminate your account at any time from inside the app, or by emailing [email protected].
We can terminate your account if:
- You materially breach these terms and do not fix the breach within 14 days of being told.
- You fail to pay an invoice and the payment remains overdue for 30 days.
- You do something that puts the service or other customers at risk (security incidents, illegal activity, harm to others).
If we terminate your account, we will tell you why in writing.
After termination, you have 30 days to export your data before we delete it. After 30 days, your data is permanently deleted from active systems. Backup copies are then deleted according to the backup retention schedule in the Privacy Policy.
10. Liability
We provide Pump House on an "as is" basis. We do our best to make it reliable and accurate, but software has bugs. We do not guarantee that the service will be uninterrupted, error-free, or fit for every purpose you might use it for.
Where the Australian Consumer Law gives you non-excludable rights (consumer guarantees), nothing in these terms reduces or removes those rights.
To the maximum extent permitted by law, our total liability to you for any claim related to Pump House is limited to the fees you have paid us in the 12 months before the claim arose. We are not liable for indirect, consequential, or special damages, including loss of profits, loss of business, or loss of data.
11. Indemnity
You agree to defend and hold us harmless from claims by third parties that arise from your breach of these terms, your misuse of the service, or your violation of any law.
12. Disputes
These terms are governed by the laws of New South Wales, Australia. Any dispute will be heard in the courts of New South Wales, unless mandatory Australian Consumer Law provisions require otherwise.
Before starting any legal action, we both agree to try to resolve the dispute by direct discussion in good faith for at least 14 days.
